SpiffBox Sweepstakes 1/19/10 to 3/19/10 Official Rules

NO PURCHASE NECESSARY OR REGISTRATION REQUIRED TO ENTER OR WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.

1.HOW TO ENTER:

The SpiffBox Sweepstakes 1/19/10 to 3/19/10 ("Sweepstakes") will begin at 12:00 p.m. US Mountain Time (MT) on 1/19/10 and end 11:59:59 a.m. MT on 03/19/10 (the "Period").

There are four ways to enter the Sweepstakes. Please note that you must agree to enter the Sweepstakes through a clearly identifiable check box on the relevant pages for 1a, 1b and 1c.

1. Tell a Friend Visit www.SpiffBox.com, sign up or log in as a valid member and then send a Tell A Friend invite through SpiffBox to a person you know. You will receive an eligible entry for each person to whom you send a Tell A Friend invite who then completes registration for SpiffBox at www.spiffbox.com and posts a valid photograph. SpiffBox will track Tell A Friend signups through the email the entrant uses to contact the prospective member. To receive a valid entry credit for this method, the prospective member must register for SpiffBox using the same email used for the Tell A Friend invitation. You may use the Tell A Friend feature to contact people you know and may not use it to spam, send bulk or automated emails.
2. Use your display name as signup code Provide a prospective member your SpiffBox display name (i.e., your name on the site, also known as a screen name) and have that prospective member input your display name into the promotion code box on the signup page. You will receive an eligible entry for each person that signs up for SpiffBox with your display name in the promotion code box who then posts a valid photo. You may go to the More, Settings, Sweepstakes page to enter the Sweepstakes in this manner.
3. Link to SpiffBox Provide a prospective member a link or button sourced on SpiffBox that when visited directs the prospective member to your profile on www.spiffbox.com. You may only source your identifiable link from SpiffBox when you are logged in to www.spiffbox.com. You will receive an eligible entry for each person that signs up for SpiffBox and posts a valid photo that arrived on www.spiffbox.com through your link. You may not participate in the sweepstakes if you are involved in the Spiffbox Affiliate Program, which also delivers prospective members to www.spiffbox.com via links.
4. Mail in EntryTo enter without completing a, b, and/or c above, please neatly print your name, complete mailing address including country, day and evening phone numbers, email address (if any), and date of birth on a piece of 3" x 5" paper and enclose this completed entry form in an envelope with first-class postage affixed and mail via US Postal Service to: SpiffBox Sweepstakes 1/19/10 - 3/19/10, PMB 278, 14700 N. Frank Lloyd Wright Blvd. #157, Scottsdale, AZ 85260. All entries must be received by 11:59 am MT March 19, 2010. No mechanically reproduced entries are accepted. Sponsor is not responsible for entries sent by mail that are not received for any reason, including entries that are lost, late, misdirected, illegible, incomplete, or have postage due. Limit one entry per outer mailing envelope. All entries become the property of the Sweepstakes Administrator and will not be returned. You do not need to register for SpiffBox to enter the Sweepstakes when you mail in an entry.

To enter the Sweepstakes with methods 1a, 1b, and 1c above, you must first agree to the Official Rules by checking a clearly identifiable box on one of the three pages that demonstrates that you wish to enter the Sweepstakes and that you have read the Official Rules which are present in a link. You need to check the box only once for SpiffBox to receive your approval for entry in the Sweepstakes and all subsequent valid TAF, link referrals and display name code inputs will count as entries in the Sweepstakes. If you do not properly enter the Sweepstakes in the manner above, you will not receive credit for past entries. You may track your entries on the More, Settings, Sweepstakes page.

Note that in the event of a conflict among sign up methods 1a, 1b, and/or 1c, that 1b will take precedence, followed by 1c and then followed by 1a. For example, if a prospective member receives a Tell A Friend email from one SpiffBox member who has entered the Sweepstakes and then inputs the display name of another SpiffBox member who has entered the Sweepstakes, the SpiffBox member whose display name is inputted in the code field would receive the entry credit.

Only (200) two hundred entries per person are allowed per Period. Additional entries beyond this limit submitted by a single person during the Period are declared void. You are only eligible to win one Sweepstakes Prize annually (calendar year) from SpiffBox, as SpiffBox may support future Sweepstakes. Entries that do not comply with the above requirements will be disqualified.

2. ELIGIBILITY:

This Sweepstakes is open only to residents of the 50 United States or the District of Columbia who are age 18 or older at the commencement of the Sweepstakes. There is no purchase necessary to enter the Sweepstakes. Employees, independent contractors, affiliates, SpiffBox Affiliate Program members, officers and directors of SpiffBox, Inc. ("Sweepstakes Administrators" or "SpiffBox"), their affiliates, their advertising and promotion agencies and their immediate family members and/or those living in the same household of each are not eligible. You are not eligible if you have been terminated by SpiffBox for breaching the Member Agreement prior to the completion of period. If SpiffBox determines that you have breached the Member Agreement before, during or after the Sweepstakes period (and prior to the disbursement of winner's check), you are not eligible. All federal, state and local laws and regulations apply. Void where prohibited by law.

3. RANDOM DRAWINGS:

After the Sweepstakes Entry Period there will be one prize drawing: for the period 12:00pm MT 1/19/10 through 11:59am MT to 03/19/10 the drawing will be held on or about 3/21/10. One (1) prize winner will be randomly selected from Eligible Entries received during the entry period on the dates indicated above. The random drawing will be conducted by SpiffBox whose decisions are final on all matters relating to this Sweepstakes. Odds of winning will depend upon the number of eligible entries received during the period of the Sweepstakes. Failure to claim a prize or provide prize delivery information or any other information requested by Sweepstakes Administrator within seventy two (72) hours of the date on which the prize is awarded may result in forfeiture of the prize. The winner will be required to execute and return an Affidavit of Eligibility and W-9 form within 10 days of being notified of winning or the prize may be forfeited. Potential Prize winner will be notified by an email message requesting contact information for prize delivery. The winner will be required to verify his/her identity including but not limited photograph identity.

4. PRIZES & APPROXIMATE RETAIL VALUES:

For each entry period One (1) prize of $1,000 (the "Prize") will be awarded. Prize will be issued in check form, U.S. dollars only. No substitutes are permitted, except by Sweepstakes Administrator in its sole discretion. Sweepstakes Administrator reserves the right to substitute the Prize with one of equal or greater value. Total value of Sweepstakes prizes equals $1,000 per period.

5. Limitation on Liability.

By entering this Sweepstakes, entrants agree to be bound by these Official Rules and agree that the decisions of Sweepstakes Administrator are final and binding in all respects and agree to release the Sweepstakes Administrators and their employees, officers, agents and directors (the Sweepstakes Administrators) and such others, collectively the "Released Parties" from any and all liability for injuries, losses or damages of any kind resulting from participation in this Sweepstakes and/or use or acceptance of any prize. No responsibility is assumed for lost, late, incomplete, stolen, misdirected, illegible or postage due entries, email or mail; or for any computer, telephone, cable, network, satellite, electronic or Internet hardware or software malfunctions, or unauthorized human intervention, or the incorrect or inaccurate capture of entry or other information, or the failure to capture any such information. Any and all claims, judgments and awards shall be limited to actual out of pocket costs incurred, but in no event attorney's fees, court costs and no punitive, incidental, special, consequential or other damages, including without limitation lost profits may be awarded (collectively, "Special Damages"), and entrant hereby waives all rights to claim Special Damages and all right to have such damages multiplied or increased.

6. ADVERTISING/USE OF WINNER'S NAME AND INFORMATION

Except where prohibited by law or regulation, winner's acceptance of the Prize will constitute permission for Sweepstakes Administrator, SpiffBox and other Released Parties to use winner's name and photo for its promotion without additional compensation, consideration or consent. Additionally by accepting a prize, winner agrees that any Affidavit and/or Releases, and any grant of permission to use the winner's name and other information, as stated above, may be secured by Sweepstakes Administrator electronically, for example but not limited to, by email or by facsimile, and such secured Affidavit and/or Releases and permission will have the same force and effect as if any of them had been secured in a written document which was physically executed by the winner.

7. GENERAL CONDITIONS:

Return of any prize/prize notification to the email address on record with SpiffBox as undeliverable will result in disqualification and an alternate winner may be selected. All federal, state, and local taxes are the sole responsibility of winner and Sweepstakes Administer will issue. By participating in this Sweepstakes, entrants agree to be bound by the Official Rules and the decisions of the judges which are final. Participation constitutes your full and unconditional agreed to and acceptance of these Official Rules and to be contacted by telephone and/or email. If you do not agree to the Privacy Policy and Terms and Conditions do not enter the Sweepstakes. Sweepstakes Administrator is not responsible for any typographical or other error in the printing, the offering or the announcement of the prizes or in the administration of the promotion. In no event will more than the stated number of prizes be awarded. Entrants agree that this sweepstakes shall be governed by the laws of the State of Arizona and any and all disputes, claims, issues, questions and causes of action arising out of or connected with the Sweepstakes, the construction, validity interpretation and enforceability of these Official Rules, or any prize awarded shall be resolved individually, and exclusively by the state or federal courts situated in the Maricopa County in accordance with the laws of the State of Arizona.

ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SWEEPSTAKES ADMINISTRATOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. In the event a dispute arises regarding specific individual entitled to receive prize, entry will be declared made by the person associated with the SpiffBox account from the selected entry, if the entry was made via 1a, 1b, or 1c. In the event the Sweepstakes is terminated prior to the end of the Entry Period, a notice will be posted online and all eligible entries received prior to termination will be included in a random drawing to award the Prize. Any damage made to the SpiffBox web site will be the responsibility of the authorized e-mail account holder of the e-mail address submitted at the time of entry. Proof of submitting entries will not be deemed to be proof of receipt by Sweepstakes Administrator. Any use of robotic, automatic, programmed or the like methods of participation will void all such submissions/votes by such methods. Sweepstakes Administrator reserves the right to prohibit the participation of an individual if fraud or tampering is suspected or if the individual fails to comply with any requirement of participation as stated herein or with any provision in these Official Rules.
